These Terms of Use (“Terms”) govern your access to and use of brainliftprogram.com and other websites, digital resources, and online services operated by Your Own Healthy, LLC, doing business as Brainlift (“Brainlift,” “we,” “us,” or “our”).

Please read these Terms carefully. By accessing or using our website or services, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use the website.

1. About Brainlift

Brainlift provides education, programs, tools, and services related to brain health, cognitive performance, resilience, healthy aging, and lifestyle change.

Depending on the offering, Brainlift services may include:

  • Educational articles and resources
  • Digital courses and programs
  • Brainlift Daily
  • Brainlift for Teams
  • Brain health assessments and educational tools
  • Events, presentations, and workshops
  • Access to clinical services through participating healthcare professionals

Certain programs or services may be governed by additional enrollment agreements, clinical agreements, payment terms, informed-consent documents, or other policies.

If additional terms apply to a particular service, those terms will control in the event of a conflict with these general Terms.

2. Educational Information Is Not Medical Advice

Much of the content available through Brainlift is provided for general educational and informational purposes.

Unless you have formally established a clinician-patient relationship with a licensed healthcare professional through an appropriate clinical service, information provided through the Brainlift website, articles, videos, emails, courses, assessments, or other educational programs:

  • Does not constitute individualized medical advice
  • Does not establish a clinician-patient relationship
  • Is not intended to diagnose, treat, cure, or prevent any disease
  • Should not replace evaluation or treatment by your own qualified healthcare professional

Do not disregard professional medical advice or delay seeking care because of information you encountered through Brainlift.

If you believe you are experiencing a medical emergency, call 911 or seek appropriate emergency care.

3. Clinical Services

Some Brainlift offerings may include or connect participants with healthcare services provided by licensed clinicians.

Clinical services are separate from general educational website content and may be subject to:

  • Eligibility requirements
  • State licensure restrictions
  • Separate informed-consent documentation
  • Separate financial and cancellation policies
  • A Notice of Privacy Practices
  • Other clinical policies and agreements

Submitting an application, questionnaire, contact form, or consultation request does not by itself establish a clinician-patient relationship.

A clinical relationship begins only when expressly established through the applicable clinical process.

4. Eligibility

You must be at least 18 years old to use this website or enter into a paid Brainlift program unless a particular program expressly permits participation by a minor with appropriate parental or legal-guardian authorization.

By using the website, you represent that you have the legal capacity to agree to these Terms.

5. Applications and Program Eligibility

Some Brainlift programs require an application or consultation before enrollment.

Submitting an application does not guarantee acceptance into a program.

We may determine that a particular Brainlift program is not appropriate for an applicant based on program scope, clinical needs, available resources, geographic limitations, level of support required, or other legitimate considerations.

When appropriate, we may suggest another service or level of care.

6. Accounts and Login Information

Certain Brainlift services may require you to create an account or receive login credentials.

You agree to:

  • Provide accurate information
  • Keep your login credentials confidential
  • Not share your account with unauthorized individuals
  • Notify us if you believe your account has been compromised

You are responsible for activity occurring through your account unless prohibited by applicable law.

We may suspend or terminate access if we reasonably believe an account is being misused or shared improperly.

7. Purchases, Payments, and Program-Specific Terms

Prices, payment schedules, subscription terms, cancellation policies, refund policies, and other financial terms may vary between Brainlift programs.

The terms presented to you at the time of purchase or enrollment will govern that transaction.

Some offerings may involve:

  • One-time payments
  • Recurring subscriptions
  • Payment plans
  • Minimum participation periods
  • Non-refundable components
  • Physical products or equipment
  • Third-party services

You are responsible for reviewing the applicable payment and cancellation terms before purchasing.

If a separate enrollment agreement applies, that agreement controls.

This is preferable to the current blanket “30-day money back guarantee on all our products,” which could conflict with how your current clinical and program offerings actually work.

8. Intellectual Property

Unless otherwise stated, the Brainlift website and its contents are owned by or licensed to Brainlift and are protected by copyright, trademark, and other intellectual-property laws.

This includes, without limitation:

  • Text
  • Videos
  • Graphics
  • Logos
  • Course materials
  • Workbooks
  • Program frameworks
  • Assessments
  • Training materials
  • Downloads
  • Software and digital tools

You may access Brainlift content for your own personal, non-commercial use unless a separate agreement expressly permits additional use.

You may not, without prior written permission:

  • Copy or reproduce substantial portions of Brainlift content
  • Sell, sublicense, or distribute Brainlift materials
  • Share paid course materials or login credentials
  • Create derivative commercial products from Brainlift content
  • Record or redistribute paid presentations or trainings
  • Use Brainlift materials to train another commercial program, course, model, or product

Brainlift for Teams clients may receive additional organizational-use rights under their specific agreement.

9. Feedback and Suggestions

We welcome feedback.

If you voluntarily send us ideas, suggestions, or comments about Brainlift, you agree that we may use that feedback to improve our products and services without compensation or obligation to you.

This does not give us ownership of your confidential medical information, personal information, or other materials unrelated to voluntary product feedback.

That distinction is important because the current Terms broadly claim ownership or perpetual rights over user-submitted information and suggestions.

10. Acceptable Use

You agree not to use the website or services to:

  • Violate applicable law
  • Attempt unauthorized access to accounts, systems, or data
  • Interfere with website security or operation
  • Introduce malicious code
  • Scrape or extract content at unreasonable scale
  • Impersonate another person
  • Provide intentionally false or misleading information
  • Infringe intellectual-property or privacy rights
  • Harass, threaten, or harm others
  • Use the services for fraudulent or abusive purposes

We may restrict or terminate access when reasonably necessary to protect Brainlift, our users, or our systems.

11. Third-Party Services and Links

Brainlift may link to or integrate with third-party websites, applications, tools, laboratories, payment processors, scheduling platforms, healthcare systems, or other services.

Those third-party services are governed by their own terms and privacy policies.

We do not control and are not responsible for the content, availability, security, or practices of independent third-party services.

A link or integration does not necessarily constitute an endorsement.

12. Results Are Not Guaranteed

Brain health, cognitive performance, health behavior, and clinical outcomes vary substantially between individuals.

Testimonials, case examples, educational discussions, and descriptions of potential benefits do not guarantee that you will achieve the same result.

Your outcomes may depend on many factors, including health status, genetics, adherence, environment, medical history, medications, sleep, nutrition, physical activity, stress, and other variables.

We do not guarantee any particular medical, cognitive, financial, professional, or performance outcome from participation in Brainlift.

13. Assumption of Responsibility

You remain responsible for your own decisions regarding your health, medical care, lifestyle, employment, business activities, and use of information obtained through Brainlift.

For educational programs, you are responsible for determining whether particular activities are appropriate for you.

Where medical clearance may be appropriate—for example, before starting a new exercise program—you should consult an appropriate healthcare professional.

14. Website Availability

We work to provide reliable services but cannot guarantee that the website or digital services will always be uninterrupted, secure, current, or error-free.

We may modify, suspend, replace, or discontinue portions of the website or services from time to time.

Where a change materially affects a paid program, any applicable program agreement will govern your rights and remedies.

15. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND GENERAL EDUCATIONAL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

BRAINLIFT DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.

NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BRAINLIFT AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR GENERAL EDUCATIONAL SERVICES.

ANY LIMITATION OF LIABILITY APPLICABLE TO A PAID OR CLINICAL PROGRAM MAY ALSO BE ADDRESSED IN THE AGREEMENT GOVERNING THAT SERVICE.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LEGALLY BE LIMITED.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Brainlift and its affiliates, officers, employees, contractors, and agents from third-party claims arising from:

  • Your unlawful use of the website
  • Your violation of these Terms
  • Content you submit that infringes another person’s rights
  • Your intentional misuse of Brainlift services

This provision does not require you to indemnify Brainlift for conduct for which indemnification cannot legally be required.

18. Copyright and Intellectual-Property Concerns

19. Privacy

Your use of Brainlift is also governed by our Privacy Policy, which explains how we collect, use, and disclose personal information.

Clinical information may also be governed by a separate Notice of Privacy Practices where applicable.

20. Changes to These Terms

We may update these Terms periodically.

When we do, we will revise the Last Updated date at the top of this page.

Material changes may also be communicated through the website, email, or other appropriate means where required.

Your continued use of the website after updated Terms become effective constitutes acceptance of the revised Terms, except where applicable law requires additional consent.

21. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.

Unless a separate agreement provides otherwise, disputes that are not subject to a valid arbitration agreement will be brought in a court of competent jurisdiction in Utah.

Your existing Terms specifically name Washington County, Utah and Utah federal court. If that is still what you want, we can make this section more specific again.

22. Dispute Resolution

You and Brainlift agree to first attempt to resolve any dispute informally and in good faith before pursuing formal legal action.

To begin that process, contact hello@brainliftprogram.com and provide a brief description of the dispute and the resolution you are requesting.

If the dispute cannot be resolved informally, it will be governed by the laws of the State of Utah and, unless a separate agreement requires another dispute-resolution process, may be brought in a court of competent jurisdiction in Utah.

Additional terms, including arbitration or other dispute-resolution requirements, may apply to specific Brainlift programs or services and will be provided as part of the applicable enrollment or service agreement.

23. Severability and Waiver

If any provision of these Terms is determined to be unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

24. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to a particular Brainlift service, constitute the agreement governing your use of the website and general Brainlift services.

A separate clinical, program, organization, subscription, or enrollment agreement may supplement or supersede portions of these Terms.
